Wrongful death is an area of law that provides compensation when someone dies as the result of the wrongful conduct of another. In the state of Florida damages are usually not awarded for the pain and suffering of the person that died. Instead, damages are awarded for economic loss to the decedent's estate, economic losses to the decedent's survivors, and pain and suffering losses to the decedent's survivors.
The real question in the state of Florida is who are the decedents survivors. Unfortunately that depends on the type of case. It differs from general personal injury cases like automobile accidents to medical malpractice cases to nursing home cases.
