Some Information About Injuries on Someone Else's Property
If you are injured on someone else’s property, you should do everything you can to remember the scene. What was the dangerous condition that caused your injury. If you slipped and fell, was there something on the floor that caused you to fall. If so, what was its shape, size, and texture. Is there something about the condition that lets you know it had been there long enough that the property owner should have been aware of the condition and fixed it or cleaned it up. If you have a camera with you, a cell phone camera will do, take pictures.
Report your injury right away. If you do not, the business may claim the event never happened. Ask if the area where the injury occurred was video monitored. If so ask for the video. Most Grocery stores and other retail businesses will fill out an incident report when someone is injured on their property. Ask for a copy of the incident report. The business does not have to give you the video or the incident report but many will. If you sign the report, it is considered your statement. Read it and make sure it is accurate. You are entitled to your statement.
