Some Information about Truck Accidents in Florida

Most people do not realize that the trucking industry is highly regulated by the state and federal government. Regulations govern the size of the vehicles, the weight of the vehicles, the route the vehicles must take, and most importantly in a personal injury case, the number of hours a driver can drive without rest. The laws require the truck driver to document in a log all of this information and more.

When we represent someone that has been injured in a collision with a semi truck, the first thing we do is get the log books. In some cases, what we find when we compare the logs to the route taken and the miles driven, we are able to prove the truck driver could not have taken the necessary rest before driving. Sometimes the eye witnesses will confirm the driver appeared to be dozing off and swerving. Occasionally the driver will admit to being overtired while driving. This is important information because the law allows us to argue to a jury that the truck driver’s lack of rest made him unable to concentrate and substantially contributed to causing the accident.
